Fair Treatment And A Fair Education Plan

If you have a child whom you suspect may have a disability, you have the right to have him or her evaluated by your school district free of charge. The Individuals with Disabilities Education Act (IDEA) requires public schools to locate and identify children who may need special education supports and services.

All children have a right to a free appropriate public education (FAPE). This means that, depending on your child’s individual needs, accommodations can include preferential seating in the classroom, use of a computer, extra time for tests, homework modification, books on tape, and more. Additionally, they may require special education supports and services, such as:

What Should Parents Know About Due Process Complaints?

A parent’s main tool for getting their children access to the services and support they need is by a due process complaint. In California, schools have a legal responsibility to provide individualized education standards for students with special learning requirements. Unfortunately, the burden for recognizing a school system’s failure to recognize and implement plans for eligible students often falls on the parents.

Here is what you need to know about that process:

  • Parents have a right to challenge a school district that denies their children a free and appropriate public education. This is done through a ‘due process hearing.’
  • You may file a due process complaint through the California Office of Administrative Hearings (OAH), which provides a neutral platform for ‘fair and independent resolutions’ between parents and a school system via an impartial judge.
  • If a school district has failed to hold an Individualized Education Program meeting, student evaluation, or complete other necessary tasks within state and federal guidelines, this may be cause for a due process complaint.
